The West Ham United defender is facing prosecution in England by the Royal Society for the Prevention of Cruelty to Animals(RSPCA)after a video emerged of him last month attacking his pet cat.
The RSPCA have since taken custody of Kurt's two cats.
The animal welfare charity have now indicated that they will begin the prosecution of Zouma and his brother Yoan, who filmed the incident, under the Animal Welfare Act.
Zouma was part of the last France squad announced by Deschamps last year but his name is missing from the latest roster for friendly matches against Ivory Coast and South Africa later this month.
The 27-year-old has continued to be selected by West Ham manager David Moyes despite his troubles but Deschamps says his decision not to go down the same route is purely for sporting reasons and not linked to the cat-kicking incident.
"I don't know if it's a strong choice," he said of Zouma's omission. "I don't know, because I haven't called him up systematically.
"In November, he came because Raphael Varane was injured. This remains a sporting choice, only sporting, as with all the choices I make.
"I've had him on the telephone and spoken with him about this affair, but I'm not going to go back over that. I've spoken about it. It remains solely a sporting choice."
Zouma has won 11 caps for the France national team, scoring one goal.
